CSE hearing even though 'stay' was filed w/ custody petition, is this unusual?
My son's father was ordered to pay child support and to put our son on his health insurance by Child Support Enforcement when our son was 3 months old. His attorney challenged the order, a hearing was set for several months later because they are so back-logged. In response to being ordered to pay support, he filed for split custody asking that I pay support and provide insurance. With his petition his attorney asked for a 'stay of administrative proceedings'. My attorney told me there would be no hearing, that the child support would be handled at the custody trial. My son is now 10 1/2 months old, and I was just reminded by CSE of the hearing date approaching. The hearing is still going to happen. When I told them I thought this issue was going to be handled in judicial court, they told me it would be a temporary order until our case goes to trial. I've never heard of this and my attorney was not expecting it. Don't get me wrong, I am very glad because I could really use the child support! Just wondering if this is typical? Is it because I am on food stamps and my son is on Medicaid?
